HHCA Emergency Meeting

 

The Board held an Emergency Meeting on Tuesday, November 26, 2019, at 6:30pm in the Community Room. The purpose of the meeting was to approve proposed Election Rules.

 

Civil Code section 4923 allows the Board to hold an Emergency Meeting “if there are circumstances that could not have been reasonably foreseen which require immediate attention and possible action by the board, and which of necessity make it impracticable to provide notice as required by Section 4920”.

So, what was the emergency?

 

Governor Newsom signed Senate Bill 323 into law on October 12, 2019.

The Board received the proposed Election Rules from legal counsel on Monday, November 25, 2019.

SB 323 requires that our HOA adopt election rules and goes into effect on January 1, 2020.

Current law requires that the proposed Election Rules be approved by Board vote, posted to the community for a minimum of 28 days for review, and then an open meeting held where the homeowners are allowed to comment on the proposed rules prior to the Board voting on adoption of the Election Rules.

 

To be in compliance with the required 28 day review process and still be able to adopt the Election Rules before the end of the year, the Board’s only option was an Emergency Meeting.

 

At the meeting, the proposed Election Rules were approved by unanimous vote and posted to the communication board located at the N. 6th St. entrance to the pool and park.
